FlyClaims

Terms of service

Last updated October 16, 2026

The short version

  • We check whether you're entitled to compensation for a delayed, cancelled or overbooked flight, and we claim it from the airline for you.
  • Our fee is 20% of the compensation we recover, including VAT. You keep 80%. There are no other fees, and if we don't win, you pay nothing.
  • When you sign, you transfer (assign) your compensation claim to us so we can pursue it in our own name. The same agreement includes a power of attorney for cases where an assignment isn't accepted.
  • We pay you within 48 hours of receiving the airline's payment and your payout details, free of charge.
  • You can withdraw within 14 days of signing, free of charge.
  • We're not a law firm and we don't give legal advice.

The rest of these terms explain the details.

1. Who we are and when these terms apply

1.1. FlyClaims is a trading name of FlyClaims (eenmanszaak), a business registered in the Netherlands with the Chamber of Commerce (KvK) under number KvK number pending, located at [address to be added]. In these terms, "we", "us" and "our" mean FlyClaims (eenmanszaak). "You" means the passenger who uses our service, or the person who submits a claim on a passenger's behalf.

1.2. These terms apply to every use of our website at getflyclaims.com, our eligibility check, the claim tracker and any agreement you make with us to pursue a compensation claim. The assignment agreement you sign when you submit a claim forms part of these terms.

1.3. You can contact us at any time at support@getflyclaims.com. Messages about a specific claim can also go to claims@getflyclaims.com.

2. What we do

2.1. We help passengers claim the compensation they're entitled to when a flight is delayed, cancelled or overbooked, under:

  • Regulation (EC) No 261/2004 ("EU261");
  • the version of that regulation that is part of UK law ("UK261"); and
  • from 23 October 2027, Regulation (EU) 2026/2202, for flights it applies to.

2.2. Our service includes checking whether your flight is likely to qualify, preparing and sending the claim to the airline, following it up, negotiating, and taking legal action where we consider it worthwhile.

2.3. If a claim goes to court, we act ourselves where the law allows it (for example before the Dutch subdistrict court, the kantonrechter), or we instruct a partner law firm. Where suitable, we use the European Small Claims Procedure. You don't need to do anything for this, and it doesn't change our fee.

2.4. We are not a law firm and we don't provide legal advice. Our eligibility check, our support chat and any information on our website give a general assessment based on the information you provide. They are not a guarantee that your claim will succeed.

2.5. We are independent and not affiliated with any airline.

3. Who can use the service

3.1. You must be at least 18 years old to sign an agreement with us.

3.2. If you submit a claim for other passengers on the same booking, such as your children or travel companions, you confirm that you're allowed to act for them. We may ask each adult passenger to sign their own agreement, and a parent or legal guardian to sign for a child.

3.3. You may only use our service for a claim that belongs to you (or to someone you're authorised to act for) and that you haven't already transferred to anyone else.

4. How a claim works

4.1. Check. You enter your flight details. We tell you whether your flight is likely to qualify and roughly how much compensation may be due.

4.2. Sign. If you want us to proceed, you sign the assignment agreement electronically. At that point an agreement is formed between you and us on these terms.

4.3. Documents. We may ask for documents we reasonably need, such as your booking confirmation or boarding pass, and occasionally a copy of your ID if the airline or a court requires it.

4.4. Claim. We send the claim to the airline and handle all communication with it. You can follow progress in the claim tracker.

4.5. Legal action. If the airline refuses or doesn't respond, we decide whether to take legal action, as described in section 2.3.

4.6. Payout. When the airline pays, we transfer your share to you (see section 7).

4.7. Airlines and courts work at their own pace. Some claims are paid within weeks; others take months, especially in court.

5. Assignment and power of attorney

5.1. Assignment. By signing the agreement, you transfer (assign) your claim for compensation against the airline to us. This means we become the owner of the claim and can pursue it in our own name, including in court. In return, we pay you 80% of the compensation we recover, as set out in these terms.

5.2. Power of attorney. The agreement also contains a power of attorney. We only use it where an assignment is not recognised, or where an airline or court requires us to act in your name rather than our own (this is the case in some countries, for example France and Spain). Under the power of attorney we act on your behalf, and the same fee and payout terms apply.

5.3. Airline terms. Some airlines' conditions of carriage say that compensation claims can't be transferred. The Court of Justice of the European Union has ruled (Case C-11/23, Eventmedia) that such clauses cannot be relied on against passengers. We will pursue your claim regardless of these clauses.

5.4. If we stop. If we decline or stop pursuing your claim (see section 10), we transfer the claim back to you, or release the power of attorney, on request and at no cost.

6. Our fee

6.1. Our fee is 20% of the compensation we recover, including VAT. This is all we charge. In particular:

  • there is no extra charge if we take legal action;
  • there are no administration, bank transfer or payout fees;
  • if your claim is not successful, you pay nothing.

6.2. You receive 80% of the compensation the airline pays for your claim.

6.3. Court costs and interest. If a court or the airline awards legal costs, court fees, collection costs or statutory interest on top of the compensation, we keep these amounts. They cover the costs we pay upfront to pursue your claim, such as court fees and lawyer or bailiff costs. Your 80% share is always calculated on the compensation amount itself.

6.4. We deduct our fee from the compensation before paying you. You never need to pay us anything upfront.

7. Payment of your compensation

7.1. We pay your share within 48 hours of receiving the airline's payment and your payout details, whichever is later.

7.2. We pay by bank transfer to an IBAN account, or by PayPal, whichever you choose. We don't charge for this.

7.3. Please make sure your payout details are correct. If a payment fails because of incorrect details, we'll contact you and pay again once they're corrected.

8. Your responsibilities

When you use our service, you agree to:

  • Be truthful. Give us accurate and complete information about your flight and what happened. If you notice a mistake, let us know.
  • Not assign the claim twice. Don't sign up with another claims company, a lawyer or the airline's own process for the same claim once you've signed with us. If you've already done so, tell us before you sign.
  • Provide documents. Send us documents we reasonably need to pursue the claim, such as your booking confirmation, boarding pass or, where required, a copy of your ID.
  • Keep us informed. Tell us straight away if the airline contacts you about the claim, offers you anything (money, a voucher, miles) or pays you directly.
  • Cooperate if needed. In rare cases, a court may need a short written statement from you. We'll explain what's needed and do the work of preparing it.

If you knowingly give us false information, or seriously break these obligations, we may end the agreement.

9. If the airline contacts or pays you directly

9.1. Once you've signed, the airline should deal with us. Sometimes airlines contact passengers directly anyway, for example with a payment or an offer.

9.2. If, after you've signed with us, the airline pays you compensation directly, or you accept a voucher, miles or other settlement from the airline for the same disruption, our fee is still due. This is because the airline's payment or offer results from the claim we submitted on your behalf, and our work led to it.

9.3. In that case, our fee is 20% of the amount the airline paid. For a voucher or other non-cash settlement, the fee is calculated on its face value, up to the amount of compensation due under the applicable regulation. We'll send you an invoice, and you agree to pay it within 14 days.

9.4. This does not apply to payments you received before you signed with us, or to refunds of your ticket price, which are not part of the compensation claim.

9.5. Because the airline can't legally pay the same claim twice, please don't accept offers directly without talking to us first.

10. When we may decline or stop a claim

10.1. We may decide not to take on a claim, or to stop pursuing it, at any time, for example if:

  • the airline can show extraordinary circumstances (such as severe weather or air traffic control restrictions) that release it from paying compensation;
  • there isn't enough evidence to support the claim;
  • the claim is time-barred (the time limit for bringing it has passed);
  • you don't provide information or documents we reasonably need; or
  • we consider the claim unlikely to succeed for another reason.

10.2. If we stop, we'll tell you why. This costs you nothing. On request, we transfer the claim back to you so you can pursue it yourself or with someone else.

11. Your right of withdrawal (14 days)

11.1. You can withdraw from the agreement within 14 days of signing it, without giving a reason and free of charge.

11.2. To withdraw, email support@getflyclaims.com or use the withdrawal option in the claim tracker. A short message is enough, for example: "I withdraw from my agreement for claim [reference]." We'll confirm receipt.

11.3. When you sign, you ask us to start work immediately, within the withdrawal period. This means we may already contact the airline during those 14 days. If you withdraw, we stop, and you don't owe us anything for the work we've done.

11.4. One exception: if, within those 14 days, the airline has already paid the compensation as a result of our claim, our service has been fully performed. In that case the right of withdrawal no longer applies and our fee is due as normal. You acknowledge this when you ask us to start straight away.

11.5. After you withdraw, we tell the airline that we no longer represent you and transfer the claim back to you.

12. Ending the agreement after 14 days

12.1. After the withdrawal period, you can still end the agreement at any time by emailing support@getflyclaims.com. We'll transfer the claim back to you.

12.2. If we had already submitted the claim to the airline before you ended the agreement, and the airline later pays compensation for that claim (to you, to us or to anyone else), our fee of 20% is still due, because the payment results from the work we did. Section 9.3 applies to how the fee is calculated and paid.

12.3. We can end the agreement as described in sections 8 and 10.

13. Liability

13.1. We pursue every claim with care, but we can't guarantee the outcome or how long it will take. The decision to pay is ultimately the airline's or the court's.

13.2. To the extent permitted by law, our total liability to you under the agreement is limited to the fee we would have received for your claim. We are not liable for indirect or consequential loss.

13.3. Nothing in these terms limits our liability for intent or gross negligence, or any liability that cannot be limited or excluded under applicable law, including your rights as a consumer.

13.4. We're not responsible for delays or problems caused by airlines, courts, banks, payment providers or other events outside our reasonable control.

14. Your account and communications

14.1. You sign in with a secure link sent to your email address (a "magic link"). Keep access to your email account secure, as anyone with access to it can sign in to your claims.

14.2. We'll communicate with you by email and through the claim tracker. Please keep your email address up to date.

14.3. Our support chat uses AI to answer common questions. It can make mistakes. For anything important about your claim, contact us at support@getflyclaims.com, and a person will reply.

15. Complaints

15.1. If you're unhappy with our service, please email support@getflyclaims.com and describe the problem. We'll look into it and reply as soon as possible, and we'll do our best to put things right.

15.2. If we can't resolve your complaint, you have the right to take the matter to the competent court. You can also contact a consumer body in your country for advice, such as ConsuWijzer (run by the Dutch Authority for Consumers and Markets) in the Netherlands, or the European Consumer Centre in your country.

16. Changes to these terms

16.1. We may update these terms, for example when the law changes or we change our service. We'll publish the new version on this page with a new date.

16.2. The terms that applied when you signed your agreement continue to apply to that claim, unless a change is required by law or is purely in your favour. If we want to make any other change to an existing agreement, we'll ask for your agreement first.

17. Governing law and disputes

17.1. These terms and your agreement with us are governed by Dutch law.

17.2. If you're a consumer living in another country, this doesn't take away the protection you have under the mandatory consumer laws of the country where you live.

17.3. Disputes will be decided by the competent court in the Netherlands. If you're a consumer, you can also bring a claim in the courts of the country where you live, and we can only bring a claim against you there.

17.4. If any part of these terms turns out to be invalid, the rest remains in force.
